What is the Valuation Date?

One of the first questions I ask a prospect is, what is the Valuation Date?


All valuations are performed as of a certain date known as the Valuation Date. This date can be current, or in the past, but cannot be a future date.


Valuation principles dictate that we must only consider information known or knowable as of the Valuation Date. (Stay tuned for a future post on known or knowable)


In states such as Florida, New York and New Jersey this Valuation Date is typically the date of filing/date of commencement of the divorce action. In other states, the Valuation Date is the most current date or the date of trial.


Each case has unique circumstances and may require a valuation at multiple dates, including the date of marriage, date of separation or a stipulated date.
